结社自由作为宪法基本权利,对其限制性措施应当符合比例原则。比例原则所包含的妥当性原则、必要性原则和比例性原则在适用时可引入国际人权公约中的“民主社会所必需”原则,从而加强价值判断的作用。比例原则的适用以及利益衡量可以借鉴德国和美国的宪法审查基准模式。我国现行结社与社团立法中存在诸多不合比例原则的规范,有待于进一步改进和完善。
As the basic constitutional rights of the people, freedom of association should be limited in accordance with the principle of proportionality. The principle of proportionality, the principle of necessity and the principle of proportionality contained in the principle of proportionality can be incorporated into the principle of “necessary for a democratic society” in international human rights conventions so as to strengthen the role of value judgments. The application of the principle of proportionality and the measurement of interest can draw on the constitutional review benchmarks of Germany and the United States. There are many norms of the principle of disproportionality in our country’s existing association and community legislation, which need to be further improved and perfected.
