传播技术的突飞猛进给人类带来了极大的便利,也给人类带来了一些新的困扰。如何保护公民的个人信息,防范政府权力的不当干涉和侵犯,依然成为公法领域的新课题。“被遗忘”权是数字化时代为保护个人信息安全和隐私权,由自然人享有的一项新型的权利。它是指在特定条件下数据主体有权要求数据控制者永久删除其信息并停止传播的权利。“被遗忘”权是人们应有的权利,它涉及言论自由与隐私自主的博弈与衡平,应予以认真对待,该权利的引进将深刻改变目前我国个人信息保护的格面。
The rapid development of communication technology has brought great convenience to mankind and brought some new disturbances to mankind. How to protect citizens’ personal information and prevent improper interference and infringement of government power has become a new issue in the field of public law. “Forgotten ” right is a new type of right enjoyed by natural persons in the digital era for the protection of personal information security and privacy. It refers to the right of the data subject under certain conditions to require the data controller to permanently delete its message and cease to transmit. “Forgotten ” right is one of the rights that people should have. It involves the game and balance of free speech and privacy autonomy, and should be taken seriously. The introduction of this right will profoundly change the current situation of personal information protection in China.
