逻辑是文化的一部分,文化的特质决定了哪一种逻辑类型会成为主流;逻辑类型又反过来影响着社会群体中主流文化的发展方向。文章通过对中西方思维方式的对比,区分了“有效性”和“生效性”两种不同的论证评价标准。并立足于中国传统思维方式和文化背景,探讨应当如何界定中国古代逻辑思想的“生效性”。最后,本文从文化的角度重新审视了“有效性”与“生效性”标准的合理性与局限性,以法学界大陆法系与英美法系的发展趋势为启示,提出合理看待论证的评价标准及其未来的发展方向。 Logic is part of culture, and cultural traits determine which type of logic will become the mainstream. Logic types, in turn, influence the direction of mainstream culture in social groups. By comparing the thinking ways of China and the West, the article distinguishes two different evaluation standards of “validity” and “validity”. Based on the Chinese traditional way of thinking and cultural background, this paper discusses how to define the “validity” of ancient Chinese logic. Finally, from the perspective of culture, this paper reexamines the rationality and limitation of the standards of “validity” and “validity”, enlightens the tendency of civil law system and common law system in jurisprudence circle, Evaluation Criteria of Evidence and Its Future Development.
