为了促进高价值移动设备的国际融资和租赁业务的开展,专门从事私法统一的政府间国际组织“国际统一私法协会”于1989年便开展了关于制定航空器、铁路机车以及空间资产的《移动设备国际利益公约》的研究。2001年,国际统一私法协会在南非开普敦召开外交会议通过了《移动设备国际利益公约》(《公约》)。该公约于2004年生效。中国是该公约的缔约方。《公约》采取的是先制订一个统一的公约,然后针对航空器、铁路机车以及空间资产的特性,分别特定议定书的模式。针对空间资产这一特定问题,国际统一私法协会于1997年邀请空间资产融资方面的专家成立了“空间工作组”(Space Working Group),负责起草《移动设备国际利益公约关于空间资产特定问题的议定书(草案)》。随后,国际统一私法协会先后召开了5次政府专家委员会会议,讨论该草案。同时,还多次召开关于空间资产的定义、空间资产登记制度、公共服务与违约救济的限制等特定问题的正式或非正式会议。由政府、卫星制造商、运营商、金融界、学者等对该草案进行了深入的讨论,并做出多处修改。2011年2月第5次政府专家委员会会议后形成的《议定书》草案文本,已由国际统一私法协会总理事会第90次会议(2011年5月9~11日召开)决定提交给将于2012年2月27日~3月9日在柏林召开的外交会议,供讨论通过。现将《议定书》草案最后文本译成中文刊出,与读者交流。
In order to facilitate the international financing and leasing of high-value mobile equipment, the inter-governmental international organization specializing in the unification of private law, the International Institute for the Unification of Private Law, carried out in 1989 the “Movement of Aircraft, Railroad Locomotives and Space Assets Equipment International Convention on Interests. ” In 2001, the International Institute for the Unification of Private Law held a diplomatic conference in Cape Town, South Africa, to adopt the Convention on International Interests in Mobile Equipment (the Convention). The convention entered into force in 2004. China is a contracting party to the convention. The Convention takes the form of a protocol specific to each protocol, followed by a convention on the characteristics of aircraft, railway locomotives and space assets. In response to the particular issue of space assets, the International Institute of Private Law invited experts in space assets financing in 1997 to set up the Space Working Group to draft the Convention on International Interests in Mobile Equipment on specific issues of space assets Protocol (Draft) ". Subsequently, UIPA convened five meetings of government experts to discuss the draft. At the same time, formal and informal meetings on specific issues such as the definition of space assets, the registration of space assets, restrictions on public services and default relief have also been held. The draft was discussed in depth by the government, satellite manufacturers, operators, financial circles and academics, and many changes were made. The text of the draft Protocol, which was formed after the fifth meeting of governmental experts in February 2011, was decided at the 90th meeting of the Council of the Univesing Association of Private International Law (May 9-11, 2011) Diplomatic Conference Held in Berlin from February 27 to March 9 for Discussion and Approval The final version of the draft Protocol is now translated into Chinese and exchanged with readers.
