《宣言》明确了WTO成员充分利用TRIPS协议中的弹性条款的权利,但并未解决TRIPS下药品专利权与公共健康权的法权冲突。我国应充分利用TRIPS协议中的弹性条款,通过立法协调和程序协调使其平衡,从而达到有效保护我国公共健康权的目的。
The Declaration clarified the rights of WTO members to make full use of the flexible provisions in the TRIPS Agreement but did not solve the conflict of legal rights under the TRIPS drug patents and public health rights. China should make full use of the flexible clauses in the TRIPS agreement to balance it through legislative coordination and procedural coordination so as to achieve the purpose of effectively protecting the right to public health in our country.
