诚实信用原则是后合同义务产生的法理基础。然而后合同义务的产生绝非一日之功,期间仅靠诚信原则的一己之力是难以独立完成的,还需经济基础的“土壤”方可生根发芽,开花结果。本文即是从经济和法理角度对后合同义务的衍生基础和制度价值做出了深入、系统的分析和研究。
The principle of good faith is the legal basis for the post-contractual obligation. However, the generation of post-contractual obligations is by no means a one-day effort. It is difficult to independently complete the contractual obligations based solely on the principle of good faith. Only the “soil” of economic foundation can take root and blossom. This article is to make an in-depth and systematic analysis and research on the derivative basis and system value of the post-contractual obligations from the economic and legal point of view.
