本文分析了刑法扩张解释的限度,结合我国目前刑事法制状况,得出扩张解释有其在当今中国存在的理论和实践根据,有必要在刑法理论和实践中允许扩张解释。并认为刑法条文所可能具有的最宽含义说是最为合理的解释。
This article analyzes the limits of criminal law’s expansion and explanation. Combining the current situation of criminal legal system in our country, we conclude that there is theoretical and practical basis for its expansion in today’s China and that it is necessary to allow the expansion of interpretation in the theory and practice of criminal law. And considered that the broadest meaning of criminal law provisions may be the most reasonable explanation.
