在法哲学范式下,语言的模糊性往往被视为法律不确定性的构成要件。但从立法角度看来,模糊语词的科学运用却是立法理论的必要构成。在立法过程中,模糊语词往往被定位为立法性语言、特殊的法律规范以及必要的立法技术。由此,模糊语词除了本身的语言意义之外,还具备了独特的法律意义。容纳法外空间、凸显语用效果以及节约立法成本即是该法律意义的典型表现。在此意义上,模糊语词的立法运用不再是构成法律不确定性的缘由之一,而是立法者对现代法治的确定性的追寻,从而使得法律的不确定性命题在立法语言运用领域获得修正。
