集体谈判在中国的悄然兴起与严重滞后的立法现状之间存在突出的矛盾,而启动集体谈判立法的关键在于高层的集体谈判法治理念的嬗变,其中落实集体表意权是形成集体谈判制度的前提法制条件,正确界定工会的定位是推动集体谈判的重要一环。我国应当抓紧借鉴国际经验、理性建构集体谈判的内容和形式,以适应集体谈判的时代潮流。集体谈判是由市场经济条件下的劳资法律关系演进中的历史规律和现实情形所证明了的客观实在,立法应当直面集体谈判。
There is a prominent contradiction between the quiet rise of collective bargaining in China and the serious lagging legislation. The implementation of collective right of consent is the prerequisite for the formation of a collective bargaining system Conditions, the correct definition of the position of trade unions is an important part of promoting collective bargaining. My country should seize the opportunity to learn from international experience and rationally construct the content and form of collective bargaining in order to adapt to the trend of the times when collective bargaining is in progress. Collective bargaining is an objective fact proved by the historical law and the actual situation in the evolution of the legal relationship between labor and capital under the condition of market economy. Legislation should face the collective bargaining.
