香港居民在内地所生子女是否拥有在香港的居留权 ,以及如何取得在香港的居留权 ,是一个由来己久的问题。由于它牵涉到社会各方面利益 ,因此在九七回归以后日渐突出 ,并进入法律程序 ,成为首宗引起全国人大常委会解释立法的案件。本文以居港权一案所引发的宪政理论、司法架构方面之问题为重点 ,对前一时期的事件进行剖析 ,以求获得对这一事件及其背后隐含意义的更深层次的诠释和理解。
Whether Hong Kong residents have children born in the Mainland that have the right of abode in Hong Kong and how to obtain the right of abode in Hong Kong is a long-standing question. As it involves the interests of all sectors of society, it became increasingly prominent after 1997 and entered legal proceedings, making it the first case that has aroused the NPC Standing Committee’s interpretation of the legislation. This article focuses on the issues of constitutional theory and judicial structure that arise from the case of Habitat Absence, and analyzes the events of the previous period in order to obtain a deeper interpretation and understanding of the incident and its implication behind it .
