企业营业秘密的产生、维持及保护与员工息息相关。为此,谨防营业秘密泄露,在当今市场竞争激烈的态势下,企业必须: 1.与员工签订营业秘密契约,规定员工在职研发的营业秘密属于企业。 2.与员工签订保密契约,员工在职期间不得有任何侵害企业营业秘密的行为,离职后也不得泄露营业秘密。
The creation, maintenance, and protection of business secrets are closely related to employees. To this end, we must guard against leakage of business secrets. In today’s fierce market competition, companies must: 1. Sign business secrets contracts with employees and stipulate that the business secrets of their employees’ research and development belong to the company. 2. Sign a confidentiality contract with the employee. During the employee’s incumbency, the employee shall not have any act that infringes on the company’s business secrets, nor may he disclose business secrets after leaving the company.
