本文阐述了机动车损害赔偿责任的意义,考察了国际上共通的做法,指出我国可以并且必须与国际接轨,阐释了机动车损害赔偿责任坚实的物理性基础和必然的社会原因以及科学的法理依据,探讨了我国机动车损害赔偿责任中颇具争论的过失判断基准、无过失责任的意义、过失相抵制度在法律公平实现中的作用等问题,阐释了机动车损害赔偿责任在侵权行为法中的定位、如何体现侵权行为法的基本原则等理论问题,探讨了机动车损害赔偿责任的成立要件及我国法律规定的现实问题。在此基础上,提出了我国机动车损害赔偿责任法的应然状态,并指出了相关的法治建设问题。文章还指出,侵权行为法学是一个理论性极强而又与社会生活和大众切身利益联系最紧密的学科领域。只有认真探讨和解决交通事故、环境污染等现代社会中具体侵权行为带来的问题,侵权行为法学才会有一个长足的发展。
