证据结构是指在运用证据证明事实的过程中,对于证据进行的排列组合以及各个证据之间的关系的总称。本文针对诉讼实务中存在的证据组织问题,提出了证据的三类结构,即链式、星式和组合式、并针对每类证据结构的优缺点和相应的组织策略提出了解决方案。并针对死刑案件的证据组织,提出了针对死刑案件的证据审查判断和办理原则。
Evidence structure refers to the use of evidence to prove facts in the process, the evidence for the permutations and combinations of evidence and the relationship between the general term. In this paper, we propose three types of evidences for the evidence organization existing in litigation practice: chain, star and combination, and put forward solutions to the advantages and disadvantages of each type of evidence structure and corresponding organizational tactics. According to the evidence organization of the death penalty cases, the principle of evidence review, judgment and handling for death penalty cases is put forward.
