近年来,随着内地房地产市场的繁荣和发展,商品房预售已经成为房地产开发商进行开发融资以及买卖的主要手段,成为内地房地产销售交易的主要方式。预售房制度在市场资源配置起了一定的积极作用,但是也显现出来许多问题,由于对商品房预售制度的监管不利,对市场以及消费者都是有利益上的威胁。本文通过对商品房预售制度的监管的研究,讨论商品房预售制度监管方面的缺陷,并提出法律上的对策。
In recent years, with the prosperity and development of the real estate market in the Mainland, the pre-sale of commercial houses has become the major means of real estate developers’ development, financing and trading, and has become the major mode of real estate sales transactions in the Mainland. The pre-sale housing system has played a positive role in the allocation of resources in the market, but many problems have also emerged. Due to the unfavorable regulation of the pre-sale system of commercial housing, there is an interest threat to both the market and the consumers. This article studies the supervision of the pre-sale system of commercial housing, discusses the defects in the regulation of pre-sale of commercial housing and puts forward the legal countermeasures.
