指导性案例效力的文本表达晦暗不明,导致指导性案例在实践中效力缺失,这在根本上缘于制度惯性造成的新制度对旧制度的路径依赖,从而使案例指导制度的运作受行政化逻辑的制约,指导性案例的适用受成文法思维的影响,同时缺乏相应的制度激励。因此,要确立指导性案例的效力,必须通过正当程序确立指导性案例的制度性权威,通过裁判说理增强指导性案例的智识性权威,并通过法官评价制度的改革建立案例指导的制度激励。
