时隔近一年,经过修改后的《国有土地上房屋征收与补偿条例》(简称《拆迁条例》)于2010年12月15日再次全文公开征求公众意见。在2010年1月29日,国务院法制办曾就条例草案公开征求意见,同一个立法项目,两次公开征求意见在我国行政法规立法中极为少见。对修法的主导思路,法制办在同时公布的草案说明中表示,条例关系到现代化建设的全局,核心是要统筹兼顾公共利益和被征收人利益,既要使公共利益需要得以实现,又要使被征收人的利益得到切实保护。
