《人民检察院办理羁押必要性审查案件规定(试行)》的发布试行,对检察机关羁押必要性审查工作提出了新的要求,检察机关统一业务应用系统也应随之完善相应功能从而更好的规范办案程序,维护犯罪嫌疑人的合法权益。本文拟分析现有统一业务应用系统下案件羁押必要性审查功能的不足,提出相应功能增加和完善的建议。
The promulgation and promulgation of the “Probationary Provisions for Handling Cases Requiring Detention by People’s Procuratorates (for Trial Implementation)” put forward new requirements on the review of the necessity of detention of procuratorial organs, and the unified business application system of procuratorial organs should also improve its corresponding functions so as to better regulate Procedures for Handling Cases and Maintaining the Legal Rights and Interests of Criminal Suspects. This article intends to analyze the deficiencies of the reviewing function of necessity of detention under the existing unified business application system and puts forward suggestions on how to increase and improve the corresponding functions.
