当前我国社会经济不断发展,使得我国与国际上的接轨情况不断增多,并且当前中国已加入了较多的国际组织,在该组织中适用的相关国际条约同样应当在中国境内正常运行。但是当前国际民商事条约在实际应用过程中,受到我国法律以及正常使用情况等限制,使得其无法完全与我国实际情况相适应。因此,本文针对国际民商事条约在中国的适用方式进行研究,并提出逐步完善该条约在中国使用的对策,希望有助于该条约在我国的良好落实。
At present, the continuous development of China’s social economy has led to an ever-increasing number of links between our country and the world. At present, China has joined more international organizations and the relevant international treaties applicable to this organization should also operate normally in China. However, the current international civil and commercial treaty in the actual application process, subject to the laws of our country and the normal use of such restrictions, making it impossible to fully adapt to the actual situation in our country. Therefore, this article studies the application of the ICC in China, and proposes measures to gradually improve its use in China, hoping to contribute to the good implementation of the ICC in our country.
