《中华人民共和国海商法》是我国第一部调整海上运输关系、船舶关系的专门性法律,它的颁布标志着我国海事法律的进一步完善,从而填补了我国法制建设中的一项空白。 (一) 海商法的立法形式。从目前各国海商法的立法情况来看,海商立法大致有三种形式:第一种是国家立法机关制定统一的海商法典;第二种是国家立法机关和政府主管部门制定单行法规;第三种是既制定统一的海商法典,又制定各种单行法规。我国《海商法》属第三种形式。建国以来颁布的一系列单行海商法规,已经基本构成了具有我国特色的海商立法体系,使一部分属于海商法范围的内容,早有了单独的法律调整。因此,我国《海商法》的制定就不再以单纯地
