理论研究中观念的更新与变革是一项长期而艰巨的系统工程,而诉讼理念直接影响着人们对诉讼的利用及诉讼理论、诉讼制度的建构。诉讼理念对制度的设计和变革起着十分重要的意义,党中央提倡建立和谐社会,而和谐社会的建设需要树立与现代诉讼制度全面契合的诉讼理念。在诉讼中以新的诉讼理念为指导,协调、处理诉讼中的各种矛盾,使案件得到公正、合理的解决。这样才能真正的实现公平正义,而公平正义也正是建设和谐社会的必然要求。
The renewal and change of concept in theoretical research is a long-term and arduous systematic project. The concept of litigation directly affects people’s use of litigation and the construction of litigation theory and litigation system. The concept of litigation plays an important role in the design and reform of the system. The Central Party Committee of the Communist Party of China advocates the establishment of a harmonious society and the construction of a harmonious society needs to establish a concept of litigation fully compatible with the modern litigation system. In litigation, the new concept of litigation as a guide, coordination, handling various conflicts in the litigation, so that the case is a fair and reasonable solution.
