对权力行使合法性和公众利益最大化的追求要求公共管理须以“公共”“管理”与“法治”为核心要素。通过法治实现公共管理须将公共管理行为置于法治框架内,结合各种法治理念、从法律维度对各类公共管理现象进行阐释和说明。公共文化管理是公共管理的一个分支,其管理理念源于公共管理的一般理论,其研究途径和研究方法也受到公共管理理论的直接影响,从法律维度对公共文化管理现象进行阐释和说明对回应公共文化需求的模糊性、变动性、个体性和多样性,对维护私权利、限制公权力、发挥市场在资源配置中的积极作用、增进自由和效率均有着重要意义。在法律语境中,公共文化服务是一种文化行政给付行为,政府须在法律规定的范围内行使文化行政权力、推进公共文化服务社会化,并给予公民相应的文化救济权利;在法律语境中,既有的文化市场管理方式须依据表达义务基本原理和法律规则内在的逻辑顺序进行从单方管理到“他律”与“自律”相协调的转变,而最大程度地保证文化生产者和文化消费者两方面的立法参与、积极推进文化行业自治则是文化市场管理方式变革的前提条件。
