“邱兴华杀人案”的审判引发了我国法学界的一场大争论。而此案最重要意义应该是对我国司法程序公正的观念与制度建立的舆论推动作用。维护司法程序公正,是司法实践结果最大程度公正的首要保障。对邱兴华杀人案件的审判做到程序公正,不仅是为了防止该案件判决不当的可能性,同等重要的是坚持程序公正才能为所有或绝大多数案件的公正判决提供制度保证。
“Qiu Xinghua murder case ” trial triggered a big debate in China’s jurisprudence. However, the most important significance of the case should be to promote public opinions on the just concept and system of judicial procedure in our country. To safeguard the impartiality of the judicial procedure is the primary guarantee for the utmost fairness and justice in judicial practice. It is not only for the sake of preventing the possibility of improper judgments in the trial of the murder case of Qiu Xinghua. It is equally important to uphold procedural fairness to provide institutional guarantees for a fair judgment in all or the vast majority of cases.
