“冷战”的结束,在很大程度上导致了一个新型帝国——“美利坚帝国”的出现。一般认为,在帝国语境下,国际法将不大可能有什么存在和发展的空间。因此,“美利坚帝国”的出现到底给当代国际法带来了什么样的影响,而当代国际法给“美利坚帝国”又产生了什么样的影响,或者,这两者之间到底会呈现一种什么样的互动关系?这个问题似乎并没有得到国际法学界和国际关系学界的应有关注和重视。因此,文章通过探讨这一问题,在更深层次上揭示出了权力政治对当代国际法所施加的各种复杂影响,从而也勾勒出国际社会在法治化进程中所遭遇到的诸多困难和挑战。当然,在论述上述问题的过程中,文章也揭示出了当代国际法在国际社会中的地位和作用。
The end of the “Cold War” has largely led to the emergence of a new type of empire, the “American Empire.” It is generally assumed that international law will be less likely to have room for existence and development under the imperial context. Therefore, what effect does the emergence of the “American Empire” have on contemporary international law and what impact does contemporary international law have on the “American Empire” or, in the end, What kind of interaction? This issue does not seem to get the attention of scholars and international relations scholars should pay attention and attention. Therefore, by exploring this issue, the article reveals the complicated influences exerted by power politics on contemporary international law at a deeper level, and also sketches the many difficulties and challenges that the international community has encountered in the process of legalization. Of course, in the course of discussing the above issues, the article also reveals the status and role of contemporary international law in the international community.
