由于我国乡镇建设加快,房屋拆迁带来的巨大利益,让原房主产生悔意,引起诉讼,现行的法律法规对于农村房屋买卖合同效力的判定并没有明确的规定,部分法院出现了“同案不同判”的现象,这不仅没有起到解决纠纷的作用,反而会损害司法权威,产生负面影响。因此我国的立法司法机关应当对这种诉讼提出统一的解决方案。本文对此进行分析,并对有关完善行为提出相关的建议。
Due to the quickening construction of towns and villages in our country and the tremendous interest brought by house demolition, regrettatizing the original homeowner caused litigation. The current laws and regulations have no clear rules on the determination of the validity of contracts for the sale and purchase of rural houses. Some courts have appeared “ Cases of Different Judgments ”, which not only failed to solve the role of disputes, but would jeopardize the judicial authority and have a negative impact. Therefore, our country’s legislative and judicial organs should propose a unified solution to such litigation. This article analyzes this, and makes relevant suggestions on the perfect behavior.
