北京市某电脑公司<买方>于1990年3月19日,与某外贸公司签订了购销合同,合同规定:卖方供应买方进口游戏机8000台,双方约定履行期限为当年8月20日。时至8月23日,卖方才迟迟通知买方提货。恰恰此前,进口关税上涨,8000台游戏机进口关税上涨合计人民币9万元。买方接到提货通知后,派出经理与之交涉。卖方认为:逾期供货非我方因素,我们无能为力,这属不可抗力;并提出9万元涨价款各承担一半的解决方案。对此,买方提出异议,双方未能达成协议。
A computer company in Beijing, on March 19, 1990, signed a purchase and sales contract with a foreign trade company. According to the contract, the seller supplied the buyer with 8,000 sets of game consoles. The two parties agreed that the period of performance should be August 20 of the same year. Until August 23, the seller delayed notification to the buyer delivery. Precisely earlier, the import tariffs rose, import tariffs on 8000 game machines rose a total of 90,000 yuan. After receiving the delivery notice, the buyer dispatched a manager to negotiate with it. The seller believes that: overdue supply of non-our factors, we can do nothing, this is force majeure; and raised 90000 yuan price increases each commitment half the solution. In response, the buyer raised objections, the two sides failed to reach an agreement.
