悬赏广告是广告人以广告的形式声明对完成广告中规定的行为的人给付广告中约定的报酬的意思表示行为。悬赏广告由广告人、以广告方法对不特定人做的意思表示、行为人完成特定行为和广告人支付报酬等部分构成。悬赏广告存在自身特殊的法律效力,悬赏人和相对人都有自身特殊的权利和义务,并且悬赏人在一定的条件下可以撤销悬赏广告。本文试从悬赏广告的概念、性质、构成要件、分类、权利和义务及撤销等角度加以探讨,肯定悬赏广告的法律效力,澄清对悬赏广告的认识,以期使今后立法与司法实践尽快协调一致。
Reward advertising is advertisers in the form of an advertisement to declare the performance of the ads specified in the payment of advertising paid advertising intent.
