通过电视传媒调解纠纷,已成为当下中国纠纷解决的一种新现象,其社会影响广泛。“表演”与“压力”是电视调解的特质,其形式新颖内容真实、调解团队强大、社会影响广泛深远。但却存在当事人没有自决权、中立性不足、调解程序不规范、隐私权保护不够等问题。中国调解总体上倾向评估式调解,带有强迫、压制,不管是说教型调解还是劝架型调解皆如此,未来中国调解包括电视调解的发展方向是向促进式调解靠近。 The mediation of disputes through the television media has become a new phenomenon in the current dispute resolution in China. Its social impact is widespread. “Performance ” and “Pressure ” are the qualities of the mediation of television. The content of the form is novel, the mediation team is strong and the social influence is far-reaching. However, the parties have no right to self-determination, lack of neutrality, irregular mediation procedures and inadequate protection of privacy. Generally speaking, Chinese mediations tend to be evaluative mediations with coercion and repression. Both preaching and mediation mediations are true. In the future, the direction of development of mediation in China, including television mediation, is toward facilitative mediation.
