妇女的劳动就业保护权利用人单位在录用职工时,除法律、法规和规章规定不适合妇女的工种或者岗位外,不得因性别原因拒绝招用妇女或者任意提高对妇女的录用标准。用人单位招用女职工,应当签订劳动合同或者聘用合同。其中劳动报酬、劳动保护条件等标准,不得低于集体合同的规定。女职工在符合计划生育规定的孕期、产期、哺乳期内,用人单位不得降低其工资,不得随意解除、终止劳动合同或者聘用合同。劳动合同或者聘用合同期满而孕期、产期、哺乳期未满的,劳动合同或者聘用合同应当顺延至孕期、产期、哺乳期满。
When hiring workers, employers shall not refuse to recruit women or arbitrarily increase the hiring standards for women unless they are not suitable for the types of jobs or positions prescribed by laws, regulations and rules. Employing units to recruit women workers should sign a labor contract or employment contract. The standard of labor remuneration and labor protection conditions shall not be lower than the stipulations of the collective contract. In conformity with the provisions of family planning, the female employees shall not lower their wages during their pregnancy, delivery and breast-feeding periods, shall not be free to terminate, terminate the employment contract or terminate the employment contract. If the labor contract or employment contract expires and the period of pregnancy, delivery and lactation is not completed, the labor contract or employment contract shall be postponed until the pregnancy, delivery and lactation expires.
