改革开放以来,中国经济迅速发展,人民生活水平也在很大程度上得到提高。但在整个新中国工业化的过程中,是以牺牲环境为代价的,随着环境污染问题日益严重以及人们环境保护意识的增强,人们日益注重对环境的管理,政府在对经济规制放松的同时,也逐步加强了对环境的规制,采取一系列的办法在确保经济稳定增长的同时,对环境进行保护,加强生态文明的建设。《中华人民共和国物权法》的通过对整个社会都有巨大的好处,如何通过物权法进行合理的环境规制,促使环境成本内部化,促进社会发展的生态化,提升相关产业发展的影响力,实现环境保护和经济发展的双赢,是一个亟待研究的重要课题。本文主要分析了物权制度为保护生态环境采取的相关限制手段,以供参考。

With the worsening of environmental pollution and the increasing awareness of environmental protection, people increasingly pay attention to the management of the environment. While the government relaxes the economic regulation, We have also gradually stepped up environmental regulation and adopted a series of measures to protect the environment and strengthen the building of ecological civilization while ensuring a steady economic growth. The passage of the “Property Law of the People’s Republic of China” has huge benefits to society as a whole. How to carry out reasonable environmental regulations through the Property Law, promote the internalization of environmental costs, promote the ecological development of society, enhance the influence of the development of related industries, and achieve environmental protection And win-win economic development, is an important issue to be studied urgently. This paper analyzes the real estate system for the protection of the ecological environment to take the relevant restrictions, for reference.
