最近几年,国家开放房屋市场,推行房屋商品化政策,允许部分公私房屋进入流通领域,使涉及房屋的纠纷相对增多。武汉市两级人民法院1985年以来受理的房屋案件,平均每年递增15%,仅次于离婚、债务、损害赔偿,居民事案件的第四位。因此,正确审理房屋案件,对于稳定社会现状,有利生产生活,维护公民、单位的合法权益,都是很重要的。本文试就审理房屋产权、买卖、租赁案件遇到的主要问题,以及完善立法,进行一些探讨。
In recent years, the state has liberalized the housing market, promoted the policy of housing commercialization, and allowed some public and private houses to enter the circulation field, thus giving rise to relatively more disputes involving housing. The housing cases accepted by two levels of people's courts in Wuhan since 1985 have increased by 15% each year on average, second only to the fourth place of divorce, debt, damages and residential matters. Therefore, proper trial of housing cases is very important for stabilizing the social status quo, facilitating production and living, and safeguarding the legitimate rights and interests of citizens and units. This article tries to discuss the main problems encountered in the trial of property rights, trading, leasing cases, and improve legislation, to conduct some discussions.
