从国内法角度,强制规则不允许当事人通过协议加以改变,而从国际私法角度,这些强制规则必须被适用而不管根据冲突规范确定的准据法为何。我国《涉外民事关系法律适用法》对强制规则作出了规定,但如何认定法律条文中的强制规则仍是一个难题。强制规则可以从法律条文本身的规定以及条文背后隐含的政策和目的加以识别,而只有那些旨在保护一国重要的政治、经济和社会利益的强制规则才能在涉外民事关系中得到直接适用,而这一点往往为我国司法实践所忽略。
From a domestic law point of view, coercive rules do not allow parties to change by agreement, whereas in the case of private international law these coercive rules must be applied irrespective of the applicable law as determined by the conflict rules. China’s “Law Applicable to Foreign-related Civil Relations,” provides for mandatory rules, but how to identify the mandatory provisions of the law is still a problem. Coercive rules can be identified from the provisions of the legal provisions themselves and the policies and objectives underlying the provisions behind them. Only those coercive rules designed to protect the important political, economic and social interests of a country can be directly applied in foreign-related civil relations. However, this point is often ignored by our judicial practice.
