建设用地使用权期限届满后存在诸多法律问题,笔者通过提出问题并予以分析,建议住宅用地续期时限按届期时房屋寿命确定,应当缴纳较低税收;非住宅用地则应允许中期续约,续期可采用“续期出让金与变动年租金”结合制;物件归属上赋予权利人补偿请求权、续期请求权及取回权;在出让金管理制度中加入“土地基金制度”;同时建议实现土地租赁制与拍卖、招标制相结合,构建完善的建设用地使用权时限制度。
