抵押是常见的一种担保形式,对于社会经济的发展有着十分重要的意义。本文从房地产抵押权的优先受偿性、追及性、特定性、附从性、不可分性、物上代位性等方面的特点,分析了房地产抵押权所涉及的一些法律问题。对建筑工程的承包人的优先受偿权优于抵押权和其他债权的原因进行了初步探讨,同时指出,在实际中我国房地产的抵押权可能是物权,也可能是债权。
Mortgage is a common form of guarantee, which is of great significance to the social and economic development. This paper analyzes the legal issues involved in the mortgage of real estate from the aspects of the characteristics such as the priority of repayment, pursuing, specificity, compatibility, indivisibility and material substitution of real estate mortgage. The priority of the contractor of the construction project is better than that of the mortgage and other claims. At the same time, it points out that in practice, the mortgage of real estate in our country may be the real right or the creditor ’s right.
