加强对儿童证人的保护是世界各国诉讼文明化的趋势。我国现有的证人制度过于笼统,缺乏对儿童证人的特殊规定,不利于儿童证人的保护。结合我国国情,建议通过完善儿童证人资格的评价标准,规定儿童证人的作证方式和询问规则,明确儿童伪证的责任承担和加强儿童证人的权利保障来构建我国儿童证人制度,从而实现诉讼的多元价值。
Strengthening the protection of child witnesses is a trend of civilizing litigation in various countries in the world. The existing system of witnesses in our country is too general and there is no special regulation on child witnesses, which is detrimental to the protection of child witnesses. According to China’s national conditions, it is suggested to construct the system of China’s child witness through the improvement of the evaluation criteria for the qualification of child witnesses, the rules of testimony and inquiry rules for child witnesses, the clear responsibility of children’s false testimony and the protection of the rights of child witnesses so as to realize the multiple values of litigation .
