一、农地征收程序及农民参与权概述(一)农地征收程序的概念由于我国既没有制定专门的土地征收征用法典,也没有单行的行政程序法典,因此对于土地征收程序的概念没有形成严格的界定。目前,我国关于土地征收程序的含义主要存在两种观点:其一认为,土地征收程序是指土地征收主体行使土地征收职权,实施土地征收过程中所遵循的方式、步骤、顺序及时限的总和。其二认为,土地征收程序是指土地征收主体在被征收主体的参与下,按照既定的规则开展土地征收的方式和步骤。笔者认为,土地征收程序的主体应当包括征收主体和被征收主体双方。土地征收程序是指土地征收主体实行土地征收行为以及被征地主体参与土地征收活动时应当遵守的法定方式和步骤。
