国际海事组织于2006年制定并通过了所有类型船舶的专用海水压载舱和散货船双舷侧处所保护涂层性能标准,该保护涂层性能标准是《国际海上人命安全公约》修正案的内容,适用于2008年7月1日或之后订立船舶建造合同建造的船舶。国际船级社协会将保护涂层性能标准的适用提前至2006年12月8日。实际上有不少船舶建造合同采用倒签的方式规避保护涂层性能标准的适用。无论是中国法还是英国法,此种倒签都将导致船舶建造合同因违法而无效,船舶所有人面临着各种因此而来的风险。
