市场经济在一定意义上讲是一种法律经济,它要求法律成为全面规范社会经济活动中各个主体的权利、义务,以及规范政府行为的准则。换句话说,市场主体之间即企业与企业之间的竞争是按法律规定的公平竞争;政府应依法来管理企业。这就要求企业必须在法律规定的范围内从事经济活动。但是,有些企业的经营者、管理人员因法律意识不强或不太熟悉经济法律知识,未能依法经营,结果给企业造成了许多不应有的经济损失。这一问题应引起注意。下面,笔者就企业经济活动中普遍存在的十个法律问题简述如下,供企业界人士借鉴、参考。
In a sense, the market economy is a kind of legal economy. It requires the law to become a standard for comprehensively regulating the rights and obligations of all the actors in social economic activities and for regulating government behaviors. In other words, competition between market players, that is, between enterprises and enterprises, is fair competition as prescribed by law; the government should manage enterprises according to law.
