金融消费者保护正成为我国金融改革的一个重要课题,美国《多德—弗兰克法案》在后金融危机时代金融消费者保护立法具有标杆意义,对美国危机的历史审视以及立法考察昭示着:做大市场与推动金融创新,绝不能消解金融监管的基础价值,金融消费者保护的思想不仅应该明确体现在金融监管目标中,还需要设置达至目标的适当监管机构。而在国外先进立法经验的本土植入需考量现实条件,要在我们的金融立法和监管中培植金融消费者保护思想,并具体体现为金融监管目标,设置由央行“牵头监管”模式为主的多层次金融消费者保护性机构。
The financial consumer protection is becoming an important issue in the financial reform in our country. The “Dodd-Frank Act” in the United States has the benchmark meaning in the legislation of financial consumer protection in the post-financial crisis era. The historical review of the U.S. crisis and the legislative inspection show that: Market and promoting financial innovation must not eliminate the basic value of financial regulation. The idea of financial consumer protection should not only be clearly reflected in the financial regulatory goals, but also set appropriate regulatory agencies to achieve their goals. However, the local implantation of advanced legislative experience in foreign countries needs to consider the realistic conditions, cultivate the idea of financial consumer protection in our financial legislation and supervision, and embody the goal of financial supervision, set the mode of “leading supervision” Lord’s multi-level financial consumer protection agency.
