库恩的“范式”给各个学科带来了新的研究视角,也使这种思考进入了新的层次。本文分析了自然法范式的历史渊源,描述了启蒙思想家们创造自然范式的简单的历史进程,结合中国的法学对自然法范式研究进行了反思,提出独创性范式的缺失并从中总结经验吸取教训。
Kuhn’s “Paradigm” has brought new perspectives on research to all disciplines and has also taken this thinking to a new level. This paper analyzes the historical origins of the natural law paradigm, describes the simple historical process by which the enlightenment thinkers created the natural paradigm, re-examines the research on the paradigm of natural law in light of Chinese jurisprudence, proposes the absence of original paradigm and draws lessons from the experience.
