深化改革以来,国有资产一直是社会各界倍加关注的热点。因为其管理和运营的好坏,直接关系到我国改革的进程、社会主义市场经济的成败、国力的强弱和民众的社会福利。因而,一批有识之士纷纷出谋献策,试图运用各种措施来促进国有资产的保值增值。为此,我们通过调查和研究,认为在目前的国有资产产权流动与重组过程中,推行公证制度,是监控其流失的重要法律手段,有利于达到盘活国有资产存量和实现国有资产保值增值之目的。本文从剖析国有资产产权流动与重组中存在的问题着手,阐明相应地实施公证制度的必要性,结合探索之中的实践,构架了建立此项公证制度的思路。 Since deepening the reform, state-owned assets have always been the focus of attention from all walks of life. Because of its management and operation, it has a direct bearing on the process of our country’s reform, the success or failure of the socialist market economy, the strength of national power and the social welfare of the people. Therefore, a group of people of insight have made suggestions and tried various measures to promote the preservation and appreciation of state-owned assets. Therefore, through investigation and research, we think that the introduction of notary system during the current process of the flow and reorganization of property rights in state-owned assets is an important legal measure to monitor the loss of state assets and is conducive to activating the stock of state-owned assets and realizing the purpose of maintaining and increasing the value of state-owned assets . This paper begins with the analysis of the problems existing in the flow and reorganization of the state-owned assets, clarifies the necessity of implementing the notary system accordingly, and constructs the idea of ​​establishing this notary system based on the practice in exploration.
