为了将不同意识形态的成员纳入到WTO体制下,WTO规定了例外条款。但是也有不少国内贸易保护集团恶意使用例外条款保护其国内产业。目前国际社会还较少援引公共道德例外免责,但未来公共道德例外会被广泛援引。探讨公共道德例外有助于我们今后更好地援引和保护我国的根本利益。文章首先论述了GATT/WTO例外条款的概念及基本内容,然后分析了适用公共道德例外的条件以及与公共秩序的区别,最后结合中国国情进一步提出了完善公共道德例外条款的建议。
In order to bring members of different ideologies into the WTO system, the WTO provides for an exception clause. However, many domestic trade protection groups maliciously use exceptions to protect their domestic industries. At present, the international community still seldom invokes public moral exemptions, but in the future public moral exceptions will be widely invoked. Exploring public moral exceptions will help us to better invoke and protect the fundamental interests of our country in the future. First of all, the article discusses the concept and basic content of GATT / WTO exception clauses, then analyzes the conditions of applying public moral exclusion and the difference with public order, and finally puts forward suggestions on how to perfect the exception of public morality according to China’s national conditions.
