回归祖国后,港澳居民的公共生活依然局限在特别行政区内,“国家—公民”关系如何维系,国家认同如何构建?兵役指向国家层面的公共领域,对促进公民身份意识,消除一国两制下的异质性,构建国家认同所需的同质性将起到重要作用。但我国的兵役法不适用于特别行政区,要消除港澳居民服兵役的法律障碍,可从兵役权利的角度探寻解决路径。
After returning to the motherland, the public life of Hong Kong and Macao residents is still limited to the special administrative region. How to maintain the relationship between “state-citizen” and how to build national identity? The military service points to the public sphere at the national level and is of great importance in promoting awareness of citizenship and eliminating the " Heterogeneity and the homogeneity needed to build national identity will play an important role. However, the law of military service in our country does not apply to the special administrative regions. To eliminate the legal barriers to the military service of Hong Kong and Macao residents, we can explore the solution path from the perspective of military service rights.
