新型城镇化过程中,家庭承包经营权流转是实现土地退出的关键。本调研报告通过2009年至2013年辽宁省9个新型城镇化试点地区家庭承包经营权流转考察,发现现行立法存在激励不足的制度障碍,提出:建立农民集体资产股权量化制度,集体财产权利确权到集体成员;建立被征收土地的留用地安置制度,保持农民集体维持农村社区生存、发展的物质条件;通过财政补贴、适度规模经营、规制流转价格等制度,促进和规范农地适度规模经营。
In the process of new urbanization, the transfer of family contractual management right is the key to the land withdrawal. This research report examines the transfer of household contractual management right in nine new urbanization pilot areas in Liaoning Province from 2009 to 2013 and finds that there is a system of impediments in current legislation. The paper puts forward the following suggestions: establishing a quantitative system of peasant collective assets and stock right, confirming the right of collective property To set up a system of resettlement of land reserved for requisitioned land so as to maintain the material conditions for peasants to collectively survive and develop in rural communities; and to promote and standardize moderate-scale management of farmland through such systems as financial subsidies, modest-scale management and regulation of circulating prices.
