健全和完善我国的违宪审查制度的必要性及其在宪政建设中的重大意义已达一致,毋需赘言。建国50多年来,我国宪法在维护政治稳定和法制建设中发挥了不可替代的作用。然而,我国的违宪审查制度虽然有明文规定但是存在很多不完善的地方。有关如何确立和完善我国的违宪审查制度的问题,在近十数年来却一直都是我国宪法学界争论的一个热点。因此为了保证宪法的有效实施,我国必须尽快建立起符合自身国情的违宪审查制度。
The necessity of perfecting the system of constitutional review of our country and its significance in the construction of constitutionalism have been agreed upon. There is no need to go into details. Over the past 50 years since the founding of our nation, our constitution has played an irreplaceable role in safeguarding political stability and legal system. However, although there is an express provision in our constitutional review system, there are many imperfections. The issue of how to establish and perfect the system of constitutional review in our country has always been a hot topic in the controversy of the constitutional scholars in the past ten years. Therefore, in order to ensure the effective implementation of the Constitution, our country must establish an unconstitutional review system that meets its own national conditions as soon as possible.
