人权是宪法的归宿,宪法是人权的保障。发展权作为一项综合性的基本人权形式,势必在扩大宪法调控视角的过程中,对宪法人权的时空进一步拓展。宪法对发展权所具有的宣示、规范和保障功能意味着发展权的宪法化选择是一种必然的趋势,我们积极探寻发展权的宪法规范方式对于丰富与发展当代宪法人权和更好地保障发展权的实现具有重要意义。
