从实证分析的角度来看,现阶段我国不当劳务派遣问题集中而且突出。究其缘由,立法规制的宽松和行政监管的缺位,是不当劳务派遣肆意横行的症结所在。本文认为,要从根本上遏制这种乱象的发生,应制定出台专门的劳务派遣法以加强立法规制,并构建由劳务派遣市场准入机制、劳动监察机制和市场退出机制组成的行政监管体系。
From an empirical point of view, the issue of improper labor dispatch in our country is concentrated and outstanding at this stage. The reason for this is that the loose constitutional regulation and the absence of administrative supervision are the crux of the indiscriminate dispatch of labor services. This article argues that to fundamentally curb the occurrence of such chaos, a special labor dispatch law should be formulated to strengthen legislative regulation and establish an administrative supervision system consisting of labor dispatch market access mechanism, labor inspection mechanism and market withdrawal mechanism .
