案例背景rn2012年1月16日,原告杜青x因单位组织文体活动受伤,同年2月4日在A医院就诊,因其三哥杜x青上了意外伤害保险,于是杜青x就诊时使用了杜x青的名字,后被诊断为“滑膜炎,有少量积液”.2013年1月21日,原告杜青x到B医院就诊,诊断为“右膝前交叉韧带断裂”,经手术治疗后出院.现原告认为因A医院初次门诊病历材料记录的姓名为杜x青,导致原告本人无法认定工伤,造成了工伤保险待遇的损失,且误诊行为导致其错过了最佳治疗时期,延误了病情.
