孟德斯鸠说过“公民的自由主要依靠良好的刑法”,在人权日益高涨的今天,随着民主法治的建立,以人为本,体现人文关怀是刑法法治的必然要求。本文从人权的角度主要对刑法的根基问题进行了探讨。
Montesquieu said that “citizens’ freedom depends mainly on good criminal law”. With the rise of human rights today, with the establishment of democratic law and order, people-oriented and embodying humane care are the inevitable requirements of the criminal law and the rule of law. This article mainly discusses the basic problem of criminal law from the perspective of human rights.
