出版物鉴定工作对依法开展“扫黄打非”、准确判定非法和违禁出版物具有非常重要的意义。在这方面,德国有逻辑清晰、体系严密的制度设计,可以为我国在出版物鉴定性质、出版物鉴定依据与标准等方面的一些理论问题提供有益的启示。与此同时,我们还可以借鉴德国的有关制度,完善出版物鉴定主体、程序等体制机制,提升“扫黄打非”工作法治化水平。
Publication identification work on the law “pornography”, accurately determine the illegal and illegal publications is of great significance. In this respect, Germany has a logical and systematic system design which can provide useful enlightenment for some theoretical issues in our country, such as the nature of publications, the basis and standards of publications. At the same time, we can learn from the relevant systems in Germany and improve the institutional mechanisms such as the main bodies and procedures for the identification of publications so as to raise the standard of legalization in the fight against pornography and pornography.
