法心理学领域已经以某种形式存在了近一百年。本文简要介绍了20世纪的法心理学,并指出事实上已存有两次法心理学运动,一次发生在20世纪前三十几年,另一次发生在20世纪的最后三十几年。尽管存有这些运动,但是为什么法心理学运动对法学影响甚微呢(心理学亦如此)?如果不去考虑——以及回答——此问题,可能就会导致运动的消亡。然而鉴于法律对个人以及社会的(影响)力,把心理学应用到法律仍是评价法律是正确有效的以及确保心理学的研究能够影响法律的重要和有益的方法。本文讨论了到目前为止,可能导致法心理学运动相对失败的十二个原因。在探讨它们,并反思为此领域带来一些成就的因素之后,本文还讨论了可能对确保法心理学领域持续的活力和影响力有所帮助的方法和策略。
The field of legal psychology has existed in some form for almost a century. This article briefly introduces the legal psychology of the twentieth century and points out that in fact there have been two psychologically legal movements, one in the first three decades of the twentieth century and the other in the last thirty years of the twentieth century. Despite these movements, why did the psychology movement have little impact on jurisprudence (and so did psychology)? Failure to think about it - and answering that question - could have led to the demise of the movement. However, applying psychology to the law, given the law’s influence on individuals and society, is still an important and useful way to assess whether law is correct and valid and to ensure that psychology research affects law. This article discusses the 12 reasons that so far have been associated with the relative failure of the psychology of legal psychology. After discussing them and reflecting on some of the factors that have contributed to this area, this article also discusses ways and strategies that may be helpful in ensuring the continued vitality and influence in legal psychology.
